1. Introduction

These Terms and Conditions ("Terms") govern your use of the Prem Enterprises website and our aluminium formwork services. By accessing our website or engaging our services, you agree to be bound by these Terms.

Prem Enterprises is a registered contractor specializing in aluminium formwork modification, refurbishment, and related construction services, operating from Pune, Maharashtra, India.

2. Services

Prem Enterprises provides the following services:

  • Aluminium formwork modification and fabrication
  • Aluminium formwork refurbishment (cutting, welding, hole filling)
  • Labour supply for formwork erection and related construction activities
  • On-site formwork supervision and quality assurance

All services are executed as per mutually agreed work orders, purchase orders, or contracts with specific scope, quantities, rates, and timelines.

3. Engagement & Contracts

All work engagements are governed by individual work orders or purchase orders issued by the client. These work orders specify:

  • Scope of work and bill of quantities (BOQ)
  • Rates, quantities, and unit of measurement
  • Project timelines, commencement and completion dates
  • Site-specific terms and conditions
  • Payment terms and milestone schedules

No work shall be initiated without a finalized rate from the contracts department and prior approval from authorized personnel.

4. Quality & Standards

  • All work is executed with good quality practice and in accordance with client specifications
  • Material handover shall be in good quality condition
  • Client's measurement is final and binding for billing purposes
  • Quality deviations resulting in time or monetary loss shall be recovered from running account bills
  • Corrective action shall be completed within the agreed schedule at no additional cost

5. Safety Compliance

Prem Enterprises maintains strict adherence to safety standards:

  • Professional supervisors are present at all times during work execution
  • All workers undergo mandatory safety induction before site entry
  • Safety equipment (ISI-marked helmets, safety belts, goggles, shoes, gloves) is mandatory
  • Compliance with Factory Act 1948 and Building & Other Construction Workers Act 1996
  • Dedicated safety engineer appointed at site
  • Full body harness required for work at unsafe elevations
  • No child labour; minimum age requirement of 18 years

Safety violations are subject to penalties as per the agreed safety penalty schedule with the principal employer.

6. Labour Law Compliance

We comply with all applicable Indian labour laws including:

  • Building & Other Construction Workers (Regulation of Employment and Conditions of Service) Act
  • Contract Labour (Regulation & Abolition) Act
  • Employee Compensation Act
  • Minimum Wages Act
  • Employees' Provident Fund (EPF) Act
  • Inter-State Migrant Workmen Act
  • Payment of Wages Act
  • Maharashtra Labour Welfare Fund Act

All necessary registrations and licenses are obtained prior to commencement. Biometric attendance and labour identification cards are maintained for all site personnel.

7. Termination

  • The client may terminate the contract at any time without prior notice in case of non-compliance with terms
  • Upon termination, all materials and equipment shall be removed within 7 days
  • Materials not removed within the stipulated period may be forfeited and disposed of by the client
  • Prior written approval is required for shifting or removing any material, machinery, or manpower from site

8. Dispute Resolution

Any disputes arising from our services or contracts shall be resolved through:

  1. Mutual discussion and negotiation in the first instance
  2. Appointment of a mutually agreed Arbitrator (3 choices communicated by each party)
  3. Arbitration proceedings held in Pune, India, conducted in English
  4. The Arbitrator's decision shall be final and binding
  5. Arbitration expenses shall be shared equally; each party bears its own preparation costs
  6. All awards shall be in writing with stated reasons

This agreement is governed by the laws of India, with exclusive jurisdiction in Pune courts.

9. Website Use

By using our website, you agree to:
